Collaborative Family Law

Collaborative Family Law is a process whereby couples work together, along with their respective collaboratively trained lawyers, to resolve all issues in relation to their family matter.  At the beginning of the process, the parties sign an agreement that they will not go to court. Collaborative law is based upon a team approach where other professionals, including financial and family specialists, may also be included to assist clients in working through the process.

Each collaborative lawyer has a duty to his or her client to ensure that all issues are understood and to provide the support needed to ensure that the client is able to make informed decisions in a safe environment. Collaborative lawyers work together towards an agreement that will satisfy their respective client’s interests and goals.

Once an agreement is reached, the collaborative lawyers draft the Separation Agreement together and after review by all parties, the Agreement is signed.

If the couple is not able to reach an agreement and negotiations break down, the Collaborative process does not continue and the couple must each retain a new lawyer to assist them in moving forward.

Kirsty is committed to the Collaborative Process as a more cost effective method of resolving family matters which allows couples input and control over the outcome, resulting in an agreement which is tailored to the specific needs of their family.
